Welcome to Aaira Travel And Tour Sdn Bhd! We’re excited to help you with your travel arrangements and look forward to being your trusted booking agent. These Terms and Conditions (the “Agreement”) outline the services you can expect from us when booking travel-related services, as well as your responsibilities as our valued customer. When we refer to “we,” “us,” or “our,” we mean Aaira Travel And Tours Sdn Bhd, and when we say “you,” we’re referring to the customer using our website, booking services, or otherwise engaging with us.
1. Our Agreement with You
Products and Suppliers
We offer a wide range of travel-related products from various Suppliers and service providers ("Suppliers"). Each Supplier has its own terms and conditions, which apply alongside our general terms. It's important that you review and understand the specific terms for each Supplier related to your bookings. Some software and content on our website are owned or licensed by us or our Suppliers and may be subject to additional conditions. Aaira Travel And Tour Sdn Bhd acts as an intermediary or “Booking Agent” for products and services not directly provided by us (e.g., air travel, ground transportation, hotel stays, meals, tours, cruises, etc.). We are not a co-vendor for these services. By booking through us, you’ll enter into a separate contract with the Supplier for the respective products and services.
Deposits and Payment
Please note that any deposit you pay is non-refundable. A deposit ensures that we can hold your reservation, but it does not guarantee the price of your booking. The price becomes fixed only once we receive full payment and issue all necessary travel documents, in accordance with the Supplier’s terms and conditions. We will inform you of the full payment deadline. By providing your payment details, you authorize us to arrange payment directly with the corresponding Suppliers. We may refuse to accept personal checks as a form of payment.
Once full payment is made, the Supplier’s terms may allow them to increase the cost of your travel arrangements. If we are acting as your Booking Agent, we will inform you promptly of any such increase as soon as we are notified. Additionally, for packages we arrange, changes in transportation costs (such as fuel, taxes, fees, and exchange rates) may affect your final price even after full payment is received.
Documentation
We typically send travel documents electronically whenever possible. Should you request hard copies, we reserve the right to charge an administration fee for this service.
Cancellations and Changes
Suppliers may have the right to cancel or amend bookings. If we are your Booking Agent, we will inform you of significant changes as soon as we are made aware, provided there is sufficient time before your departure. However, we accept no liability for any changes or resulting costs. In such cases, you may have the option to accept the change, choose alternative arrangements if the Supplier offers them, or cancel your booking and receive any applicable refunds, subject to the Supplier’s terms. Please note that we cannot guarantee refunds.
If you’ve booked a flight and we are notified of a significant schedule change before you leave your home country, we will contact you by email. Make sure we have your correct email address and check it regularly before your trip. We are not responsible for airline schedule changes and cannot accept liability for any costs incurred due to such changes.
Once you’ve left your home country, it’s your responsibility to confirm with the airline that any subsequent flights are still operating as scheduled. We highly recommend contacting your airline at least 72 hours before each scheduled flight to confirm your travel plans. Some airlines may require you to reconfirm your flight intentions, so please check with them directly.
2. Your Agreement with Us
Your Acceptance of These Terms and Conditions
By booking through us or using our website, you agree to comply with the terms of this Agreement, including Parts 1-3, as well as any additional terms and conditions of any applicable Suppliers. You acknowledge that you, on behalf of yourself and anyone you represent, are responsible for adhering to these terms, including timely payment of all amounts due. Any violation of these terms may result in (a) cancellation of your reservation or purchase, (b) forfeiture of any monies paid, (c) denial of access to the relevant travel service, and (d) the right for us to charge you for any costs incurred due to the violation.
You confirm that (a) you are of legal age to use our services and can enter into binding agreements, (b) you are authorized to act on behalf of others you represent, and (c) the information you provide is accurate. You are also responsible for informing others in your party about the terms and conditions that apply to their travel arrangements. You understand that you are financially responsible for any use of our services or website under your name or account.
If You Change Your Booking
If a change to your travel arrangements is possible and permitted, standard service fees may apply in addition to any charges from the Supplier. Changes are subject to availability and the terms of the product purchased. Please note that many airlines and Suppliers do not allow name changes. If such a change is necessary, we will attempt to make it, but in most cases, name changes are treated as cancellations, which will be subject to the Supplier's cancellation policies and charges.
Flights must be taken in the order they appear on your ticket or e-ticket confirmation. If you decide not to take a scheduled flight, please contact the airline well in advance to explore your options. Failure to check in on time could result in your ticket being void, or you being marked as a "no-show," which may lead to additional charges or cancellation of your entire itinerary.
If You Cancel Your Booking
If you cancel your arrangements, you may be entitled to a partial refund, subject to the cancellation terms of your Suppliers and any standard fees we apply, as outlined in your booking confirmation. Refunds will be processed only once we receive the relevant funds from the Supplier. Please note that flight tickets are generally non-refundable if partially used. If your cancellation is covered under your travel insurance, you may be able to recover cancellation charges from your insurer.
Important Notice Regarding Airline Reservations
If you arrive at the airline check-in counter with a confirmed reservation but the airline shows no booking, do not leave the counter. Check your ticket status. If it shows "OK" for the flight, the airline should accommodate you or, if unavailable, find an alternative flight or compensate you for denied boarding. If necessary, request to speak with a Manager.
If You Have a Complaint
If you encounter any issues during your holiday, notify the relevant Supplier (such as your hotel) immediately. If the issue isn’t resolved, contact us promptly through the office where you made your booking or via http://aairatravelsabah.com. Timely notification is important so we can investigate and address the problem while you’re still on your trip. Delayed notifications may affect your rights under this Agreement.
Travel Documents and Destinations
It’s your responsibility to ensure that all details on your travel documents are accurate. If you notice any errors, inform us immediately. Travel documents should be treated with care as they are valuable and may not be replaceable if lost or damaged. Before booking international travel, we recommend reviewing any government warnings or advisories related to your destination. Offering travel to a specific destination does not imply that it is risk-free or without hazards.
Passport, Visa, and Immigration Requirements
You are responsible for meeting all passport, visa, and other immigration requirements for your trip. Confirm these with the appropriate embassies or consulates. We are not liable if you are unable to travel due to failure to meet these requirements. If traveling on special student, youth, or teacher tickets, ensure you carry a valid International Student I.D., Youth I.D., or Teacher I.D. card. Verify this with our travel experts before your journey.
Insurance
We strongly recommend that you purchase comprehensive travel insurance for your trip. In some cases, travel insurance is mandatory. We can assist in arranging insurance or provide quotes if needed, and we’re happy to answer any related questions.
Use of Our Services and Website
You agree to use our website and services solely for legitimate bookings and not to make speculative, fraudulent, or false reservations. Your use of our website must comply with applicable laws. Without prior written consent, you may not use automated tools (like "robots" or "spiders") to access, monitor, or copy content from our website. You may not deep-link to any portion of our site or "frame" any part of it into another website.
Our website may contain links to third-party sites for your convenience. However, we are not responsible for the content of these sites or for any security risks they may pose, such as viruses or malware. We do not endorse any third-party websites, and we urge you to take precautions when accessing them.
Indemnification
You agree to indemnify and hold harmless Masenang Tours & Travel Sdn Bhd, our affiliates, Suppliers, and their officers, employees, and agents from any claims, damages, or losses arising from (a) your breach of this Agreement, (b) your violation of laws or third-party rights, or (c) your use of our website and services.
